Artificial Intelligence

The capabilities of generative artificial intelligence (AI) are advancing at an unprecedented rate, raising uncharted legal issues as AI is being used more widely every day. The collection of content by AI companies for databases used to train models raises special challenges for copyright owners, and dozens of lawsuits are making their way through the U.S. legal system. In addition to closely monitoring developments in the U.S. and abroad, we are leveraging our deep expertise in Intellectual Property and Privacy to give our clients advice in a fluid environment.

Firm attorneys are involved in the legal industry’s efforts to set standards for responsible use of AI, both internally and with respect to client ventures. Janet Fries is a member of the AI Task Force of the American Bar Association’s Intellectual Property Law Group, which has developed an AI Terminology Glossary. Firm attorneys address fellow lawyers, business leaders, educators and others on AI issues related to intellectual property.

Representative Matters

  • Helping clients protect their AI-related IP through a combination of copyright, trademark, patent and trade secret strategies
  • Providing risk assessment criteria to clients using AI
  • Addressing harms caused by AI infringements
  • Adapting decades of experience in compulsory copyright royalties for cable and satellite retransmissions to establish strategic partnerships to explore a similar model for AI use of copyrighted works
