Arnold Lutzker practices copyright, trademark, Internet, art and entertainment law. He counsels on issues of ownership and use of intellectual property. He assists clients in matters of selection and registration of trademarks, licensing and effective management of trademark and copyright portfolios, and taking action on infringement claims. He has special expertise in the trademark and copyright issues that surround new media, intellectual property policy, and education. Mr. Lutzker's clients include companies in the media, software and hardware, film and television program production and telecommunications, and the Internet, as well as leading academic and library institutions.

In the legislative area, he has represented a consortium of five national library associations on the Digital Millennium Copyright Act (DMCA), Sonny Bono Copyright Term Extension Act (CTEA), and the TEACH Act. He also has represented the Directors Guild of America and The Film Foundation in connection with their effort to protect classic American movies.  In the arena of appellate litigation, he filed amicus briefs for numerous library and educational associations in U.S. Supreme Court and courts of appeal cases. These include:  The New York Times Company, Inc. v. Tasini , 533 U.S. 483 (2001) ( brief in support of authors when their articles are republished in electronic databases without prior approval or compensation); National Geographic Society v. Greenberg , 534 U.S. 951 (2001) , Faulkner v. National Geographic Society , 409 F.3d 26 (2d Cir. 2005), Greenberg v. National Geographic Society , 244 F.3d 1267 (11th Cir. 2001), and Greenberg v. National Geographic, No. 05-16964-JJ (11 th Cir. filed June 6, 2006) ( Supreme Court 2001 brief , Supreme Court 2005 brief , Second Circuit 2004 brief and Eleventh Circuit 2006 brief , in support of National Geographic Society's right to create a CD-Rom version of 100 years of magazine publications in the face of a copyright challenge by freelance photographers); and Eldred v. Ashcroft , 537 U.S. 186 (2003) ( brief supporting the challenge to the constitutionality of the 1998 Copyright Term Extension Act). The firm also filed an amicus brief on behalf of two noted economists concerning peer-to-peer file sharing in the landmark case of Metro-Goldwyn-Mayer Studios Inc. v. Grokster, Ltd . , 125 S. Ct. 2764 (2005). In federal district court litigation, he defended a client's Internet advertising practices against claims of copyright and trademark infringement and defended a software company's sale and distribution of innovative DVD backup and restoration software and the public's fair use rights.

Mr. Lutzker was a chief organizer of the traveling art exhibition, Palace of Gold & Light: Treasures from the Topkapi, Istanbul, which toured in Washington, D.C., San Diego, California, and Fort Lauderdale, Florida in 2000-2001. Previously, he served as special legal advisor to JEWELS OF THE ROMANOVS: Treasures of the Russian Imperial Court (1996-1998). He is counsel to and co-founder of Entera Entertainment, Inc., a film production company. He is general counsel of the Cultural Alliance of Greater Washington and a board member of Filmfest DC.

He is the author of three books, Content Rights for the Creative Professional: Copyrights and Trademarks in a Digital Age (Focal Press, 2002), which has recently been published in a Russian edition; Copyrights and Trademarks for Media Professionals (Focal Press, 1997) and Legal Problems in Broadcasting (Great Plains University Press, 1974), a video, Copyrights: The Internet, Multimedia and the Law (Taylor Communications, 1997), and numerous articles on copyright and trademark issues. Prior to establishing Lutzker & Lutzker with his wife, he was a principal in the Washington law firm of Fish & Richardson, P.C. and a partner in Dow, Lohnes & Albertson. He graduated from City College of New York (1968, magna cum laude) and Harvard Law School (1971, cum laude).
